Terms of Service
Effective date: 2026-08-15 (draft)
Draft — these terms are being reviewed by counsel and may change before they take effect.
Acceptance
These terms are an agreement between you and BeeMar Capital (“BeeMar”, “we”, “us”) covering beemarlending.com, the Builder Partner portal, and the invitation and application tools on it. [counsel to confirm]
By using the site — applying to the Builder Partner program, sending an invitation, starting an application, or simply browsing — you agree to these terms. If you do not agree, do not use the site.
Our Privacy Policy explains how we handle information and is part of this agreement.
Who may use BeeMar
You must be at least 18 years old and able to enter a contract. There are two kinds of accounts:
- Builder Partners — home-improvement contractors we have reviewed and approved. A Builder Partner acts on behalf of a business and confirms they are authorized to bind it.
- Homeowners — people exploring financing for work on a property they own or are responsible for. Homeowners do not need an account to apply; an invitation or the public application form is enough.
Keep your sign-in link and any invitation code to yourself. Tell us promptly if you think someone else has used them.
The Builder Partner program
Application and approval
Applying does not make you a Builder Partner. BeeMar reviews every application and may approve or decline it at our discretion, and may suspend or end a partnership at any time. [counsel to confirm]
Accurate information
Everything you tell us about your business — licensing, trades, states served, volume — must be accurate and kept current. We may verify it, and we may act on inaccurate information by suspending your access.
One invitation per customer
Each invitation code is for one customer and one project. Do not reuse a code, publish it, or hand the same code to more than one person. Codes expire 30 days after they are created, and you can revoke one at any time from your portal.
Contacting your customer
When you enter a customer’s email address or mobile number, you confirm that the customer gave you that information and agreed to be contacted about financing for their project. Consent to receive text messages must come from the customer themselves — you cannot give it on their behalf, and BeeMar’s messages always tell the recipient how to stop. You are responsible for complying with the laws that apply to your own marketing and outreach. [counsel to confirm]
What you see
Your portal shows high-level status for the customers you invited: invitation sent, application started, under review. It does not show your customer’s financial information, and you may not ask BeeMar for it.
No agency
Being a Builder Partner does not make you our agent, employee, or joint venturer, and does not let you make promises about financing on our behalf or on a financing partner’s behalf. [counsel to confirm]
Homeowner applications
BeeMar is not a lender. BeeMar acts as a consultant, working with home-improvement contractors to help pair homeowners with financing options available through participating financing partners. We do not make credit decisions and we do not lend money. [counsel to confirm]
Submitting an application is not an offer or a guarantee. Approval, rates, terms, fees, availability, and funding are determined by participating financing partners and by borrower qualifications. Timing varies by financing option and project. Nothing on this site is a commitment to lend. [counsel to confirm]
You agree that the information in your application is true and complete, and that you are applying for yourself. If we or a financing partner needs to verify something, we may ask you for more.
Any payment example on this site is illustrative only. It is not an offer and not a final financing term.
BeeMar does not choose your contractor for you, supervise the work, or guarantee it. The agreement for the work itself is between you and your contractor. [counsel to confirm]
Acceptable use
Do not:
- Submit information that is false, or that belongs to someone who did not ask you to submit it.
- Apply on someone else’s behalf without their knowledge.
- Share, sell, or publish invitation codes.
- Try to reach accounts, applications, or data that are not yours.
- Scrape the site, hammer our forms, or run automated traffic against them.
- Interfere with the service, probe it for vulnerabilities, or work around our limits.
- Use BeeMar for anything unlawful, or in a way that violates rules about credit, advertising, or telemarketing.
We may limit, suspend, or end access to anyone who does these things, and we may remove content without notice.
Intellectual property
The site, its design, copy, and the BeeMar Capital name and logo belong to BeeMar Capital or its licensors. You may use the site for its intended purpose. You may not copy, republish, or build a competing product from it, and you may not use our name or logo without written permission.
Builder Partners keep ownership of the business information and logo they give us, and grant BeeMar permission to use them to operate the service — for example, showing your company name to the customer you invited. [counsel to confirm]
Disclaimers
The site is provided “as is” and “as available”. To the extent the law allows, BeeMar disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. [counsel to confirm]
We do not warrant that the site will be uninterrupted or error-free, that an invitation or email will always be delivered, or that any financing will be available on any particular terms. Nothing here is legal, tax, or financial advice.
Limitation of liability
To the extent the law allows, BeeMar is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or lost data, arising from your use of the site. Our total liability for any claim relating to the site is limited to [AMOUNT — placeholder]. [counsel to confirm]
Some states do not allow these limits, so parts of this section may not apply to you. [counsel to confirm]
Governing law
These terms are governed by the laws of [STATE — placeholder], without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in [COUNTY, STATE — placeholder], and both sides consent to that venue. [counsel to confirm]
Whether these terms include an arbitration clause or a class-action waiver has not been decided. [counsel to confirm]
Changes to these terms
We may update these terms. When we do, we change the effective date at the top, and we tell Builder Partners by email before a material change takes effect. Continuing to use the site after a change means you accept the updated terms. [counsel to confirm]
